Is a coroners report public record in California? ›

Public Records Act request policy

The California Public Records Act (PRA), Government Code Sections 6250 to 6270, requires the Santa Clara County Medical Examiner-Coroner's Office to make public records available for inspection by the public and to provide copies upon request.

How long is the body kept at the Coroner's office? Normally we try to release the decedent to a funeral home within two to three days. Depending on the circ*mstances of the death, and confirming identification, sometimes it is necessary to keep the remains longer.

The coroner's report is a form document that includes basic information about the person who has died, what funeral home is handling arrangements, the next of kin and the cause and manner of death. The postmortem examination report is a detailed document that outlines every finding from the autopsy.

Obtaining Certified Copies of ​​Death Certificates

The California Department of Public Health – Vital Records (CDPH-VR) maintains a permanent, public record of every death that has occurred in California since July 1905.

With the permission of the landowner, all states permit private burial of cremated remains, including California as of 1998.

If you are considering a home burial for a loved one, it is good to know that most states make it perfectly legal to take a body home from the hospital, nursing home, or other institution and bury it on your private property. There is no charge to the family for an autopsy that is required by the State of California. The cost is absorbed through the operation of the Medical Examiner Office and funded through tax dollars. In the event of a family-requested autopsy, a fee will be charged.
